WEST PALM BEACH – A Palm Beach County woman alleges a Boynton Beach business has barriers that restricted her access to the property.
Janet Hoyt filed a complaint on March 30 in the U.S. District Court for the Southern District of Florida, West Palm Beach Division against Capitol Carpet and Tile of Boca Raton Inc., doing business as Capitol Carpet & Tile and Window Fashions, alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that she visited the defendant's property on Feb. 1 and suffered discrimination, injury and damage from being denied full and equal access and enjoyment of the services, programs, goods, amenities and activities being offered there. The plaintiff holds Capitol Carpet and Tile of Boca Raton Inc. responsible because the defendant allegedly does not have accessible restrooms.
The plaintiff seeks judgment against defendant, an order for the defendant to alter the premises, attorneys' fees, all costs, court costs and expert fees, and further relief as it may deem just. She is represented by Jason S. Weiss and Zachary W. Smith of Weiss Law Group PA in Coral Springs.
