MIAMI — A passenger is suing Carnival Corporation d/b/a Carnival Cruise Lines for allegedly taking insufficient measures to prevent injuries.
Kimberly Dixon filed a lawsuit on March 30 in the U.S. District Court for the Southern District of Florida alleging that one of the cruise ship operator's employees failed to exercise reasonable care under the circumstances.
According to the complaint, the plaintiff alleges that she was lawfully aboard defendant's vessel, Splendor, on Feb. 28, 2016. While leaving the ship with her luggage, the defendant's employee negligently mishandled a swinging door and struck the plaintiff's knee, resulting in physical and mental pain, loss of earnings, disability and medical and nursing expenses. The plaintiff holds the defendant responsible for allegedly failing to provide reasonably safe exits for its passengers and negligently allowed this dangerous condition to exist despite prior similar incidents.
The plaintiff requests a trial by jury and seeks judgment, interest and costs and such other relief to which the she may be justly entitled. She is represented by Glenn J. Holzberg of Holzberg Legal in Miami.
