MIAMI — A Duke Energy employee is suing Aetna Life Insurance Company, claiming Aetna wrongly terminated her long-term disability benefits.
Cindy Wright filed a complaint on March 30 in the U.S. District Court for the Southern District of Florida alleging that the insurer violated the Employee Retirement Income Security Act of 1974.
According to the complaint, the plaintiff alleges that, on Feb. 27, 2016, she stopped receiving the benefits owed to her under her long-term disability plan. As a result of the improper determination of her claim, she has suffered and will continue to suffer loss of benefits. The plaintiff holds Aetna responsible because it allegedly unlawfully denied and refused to pay her benefits benefits and failed to properly and adequately investigate the merits of her claim.
The plaintiff requests a trial by jury and seeks reinstatement to the plan, payment of all costs and attorneys’ fees, interest and such other and further relief as the court deems just and proper.
