Minit Mart alleged to have non-ADA compliant restroom

JACKSONVILLE – A disabled Duval County man a business in the county has barriers and cannot accommodate disabled patrons.

Clester Matthews filed a complaint on March 29 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Parth Lane Inc., doing business as Minit Mart, alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he has suffered discrimination, injury and damages from being denied full and equal access and enjoyment of the services, programs, goods, amenities and activities being offered at defendant's property because of the illegal architectural barriers situated therein.

The plaintiff holds Parth Lane Inc. responsible because the defendant's property did not have a door wide enough for the restroom to accommodate his wheelchair and other barriers.

The plaintiff seeks judgment against the defendant, declaratory and injunctive relief, attorney's fees, costs, litigation expenses and other relief as the court deems just. He is represented by Robert Gibson of Law Office of Robert Gibson in Jacksonville.
