MIAMI – A man alleges his disability benefits were terminated without a prompt and reasonable explanation.
Paul Rubio filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida against the Metropolitan Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that on June 8, 2016, he stopped receiving his disability benefits under the long-term disability plan administered by the defendant. The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant allegedly denied his continued claim for long-term disability benefits and informed him that he had exhausted all administrative remedies and that no further appeals will be considered.
The plaintiff requests a trial by jury and seeks payment of disability benefits, costs and attorneys’ fees for this action, pre- and post-judgment interest and such other just and proper relief.
