FORT LAUDERDALE – A former cashier and general store employee for a Pembroke Park retail business alleges she was terminated in retaliation.
Isabel Caamano, individually and on behalf of all others similarly situated, filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Fuel Energy Hallandale LLC and Gilberto Garay alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that, she worked an average of 64 hours every week and that she was paid her regular rate for the overtime work. The suit states she was fired on Dec. 20, 2016, for demanding for overtime payment at the correct rate. The plaintiff holds Fuel Energy Hallandale LLC and Garay responsible because the defendants allegedly failed to maintain accurate time records and failed to compensate her at the rate of time-and-one-half of her regular rate of pay for every hour worked in excess of 40.
The plaintiff requests a trial by jury and seeks actual damages for unpaid overtime wages, liquidated damages, attorney's fees and costs and such other equitable and just relief. She is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
