Midland Credit Management alleged to have harassed consumer with frequent calls

TAMPA – A Hillsborough County resident alleges a debt collector called her without her prior express consent.

Nancy Little filed a complaint on March 29 in the Tampa Division of the Middle District of Florida against Midland Credit Management Inc. alleging that the creditor violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that the defendant began calling her in March 2016 to collect an alleged debt. The plaintiff holds Midland Credit Management Inc. responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, unlawfully utilized an automatic dialer and automated voice, and contacted plaintiff without prior express consent.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory, punitive, actual and treble damages, costs, interest, attorney's fees, enjoinder from further violations and other relief the court may deem just. She is represented by Jared M. Lee of Morgan & Morgan PA in Orlando.
