TAMPA – A Port Richey homeowner alleges a bank misrepresented the character, amount and legal status of an alleged debt.
Barbara Leslie filed a complaint on behalf of herself and all similarly situated individuals on March 29 in the Tampa Division of the Middle District of Florida against JPMorgan Chase & Co., doing business as Chase Bank, alleging violation of the Fair Debt Collection Practices Act.
According to the complaint, the defendant serviced her home mortgage and the plaintiff agreed to its trial modification payment schedule. She alleges the defendant later refused to honor the modification without explanation.
The plaintiff requests a trial by jury and seeks judgment against defendant, certify action as a class action, statutory damages, declaratory judgment, attorney's fees and further relief as the court deems just. She is represented by Brandon J. Hill of Wenzel Fenton Cabassa PA in Tampa.
