MIAMI – A Miami auto business is accused of failing to provide adequate parking for disabled patrons.
Renzo Barberi filed a complaint on March 29 in the U.S. District Court for the Southern District of Florida against Cutler Bay Tire and Auto Service Center Inc., doing business as Goodyear, Kevin E. Pedersen and Michelle Pedersen alleging that they violated Title III of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that he visited the defendants' facility and was denied full, safe and equal access to the facility. The plaintiff holds Cutler Bay Tire and Auto Service Center Inc. and Kevin E. Pedersen and Michelle Pedersen responsible because the defendants allegedly do not have a compliant parking space for the disabled.
The plaintiff requests a trial by jury and seeks an order requiring defendants to alter the subject facility to make it accessible to and usable by individuals with disabilities, attorney's fees, costs, expenses and such other just and proper relief.
