Former U.S. Water Services Corp. employee alleges he was paid regular rate for overtime work

TAMPA – A wastewater operator has filed a class-action lawsuit against a water systems distribution operator company for allegedly failing to properly compensate him for overtime work.

Jimmy Moore, on his own behalf and on behalf of those similarly situated filed a complaint on March 28, in the Tampa Division of the Middle District of Florida against U.S. Water Services Corp. alleging that the defendant violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between April 2015 and Dec. 2016, he was classified as an independent contractor and was paid on an hourly basis for services performed. Employees routinely worked in excess of 40 hours per week as part of their regular job duties, the suit states. The plaintiff alleges the defendant failed to pay plaintiff and those similarly situated to him overtime compensation at a rate of time-and-a-half of their regular rate of pay for hours worked over 40 in a workweek and instead only paid the regular rate.

The plaintiff requests a trial by jury and seeks judgment for liquidated damages, attorneys' fees, costs, pre- and post-judgment interest and all further relief that this Court determines to be appropriate. He is represented by Kimberly De Arcangelis of Morgan and Morgan, PA in Orlando.
