TAMPA – A Pinellas County consumer alleges a debt collector frequently contacted her after she notified it that she was represented by counsel.
Virginia Brown filed a complaint on March 28 in the Tampa Division of the Middle District of Florida against TD Bank NA alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that the defendant is calling her in its attempt to collect on an alleged debt. The plaintiff holds TD Bank NA responsible because the defendant allegedly continued to make calls despite plaintiff's explicit demand to stop the improper calls, unlawfully utilized an automatic telephone dialing system and/or an artificial or pre-recorded voice, and called her after she instructed it to contact her counsel.
The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages, and other relief the court deems just. She is represented by Christopher W. Boss of Boss Law in St. Petersburg.
