Woman seeks reinstatement of disability benefits from United of Omaha Life

FORT MYERS – A woman alleges that she is disabled and that an insurer that does business in Hendry County wrongfully denied her claim for disability benefits.

Mildred Canales filed a complaint on March 27 in the U.S. District Court for the Middle District of Florida against United of Omaha Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff applied for long-term disability benefits from the defendant and was denied. The plaintiff holds United of Omaha Life Insurance Co. responsible because the defendant allegedly failed to comply with its own internal rules, protocols and guidelines on adverse determination and failed to pay disability benefits payments to plaintiff.

The plaintiff seeks judgment against defendant, declaratory relief, reinstatement of benefits, interest, costs, attorney's fees and other relief as the court may deem just. She is represented by William S. Coffman of Coffman Law in Tampa.
