Cleaning crew worker claims Federal Cleaning failed to pay overtime wages

Law money 04

ORLANDO — A man is suing Federal Cleaning Contractors Inc., citing alleged unpaid wages, violation of applicable minimum wage law and violation of workers compensation acts.

James Sanchez filed a complaint on March 27 in the U.S. District Court for the Middle District of Florida alleging that his former employer failed to provide employees their proper wages. Sanchez was employed as an hourly worker to provide cleaning services to a construction site in Volusia County where a Bass Pro Shops was being built.

According to the complaint, the plaintiff alleges that he has suffered loss of earnings for working additional hours in excess of 40 per week, frequently 56 hours a week or more, since his hire but was not paid proper overtime wages by the defendant at the statutory rate of one and a half the regular rate of pay. Therefore, he claims he was not paid the proper minimum wage as dictated by law. The plaintiff holds Federal Cleaning Contractors responsible because it allegedly failed to properly apprise its employees of their rights under the Fair Labor Standards Act, failed to keep or provide an accurate record of its employees' hours worked and failed to compensate its employees for overtime wages.

The plaintiff requests a trial by jury and seeks judgment against defendant, reimbursement of lost wages and liquidated damages, costs, attorney's fees and further relief as the court deems proper. He is represented by W. John Gadd of The Law Office of W. John Gadd in Clearwater and Kyle J. Lee of Lee Law PLLC in Brandon.
