FORT LAUDERDALE – A Plantation man claims debt collectors falsely represented an alleged debt.
Stephen Aronson filed a complaint on March 24 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Midwest Recovery Systems LLC and O'Brien, Wexler & Associates LLC citing the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that on Nov. 7, 2016, the defendants emailed him stating that he owed $775. He alleges he paid the debt in full in 2013. The plaintiff holds Midwest Recovery Systems LLC and O'Brien, Wexler & Associates LLC responsible because the defendants allegedly threatened to communicate credit information that is known or should be known as false.
The plaintiff requests a trial by jury and seeks judgment against defendants, statutory damages of $1,000 per defendant, actual damages, attorneys' fees, costs, interest and further relief as the court may deem proper.
