Man alleges debt collectors tried to collect on debt he paid off

FORT LAUDERDALE – A Plantation man claims debt collectors falsely represented an alleged debt.

Stephen Aronson filed a complaint on March 24 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Midwest Recovery Systems LLC and O'Brien, Wexler & Associates LLC citing the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Nov. 7, 2016, the defendants emailed him stating that he owed $775. He alleges he paid the debt in full in 2013. The plaintiff holds Midwest Recovery Systems LLC and O'Brien, Wexler & Associates LLC responsible because the defendants allegedly threatened to communicate credit information that is known or should be known as false.

The plaintiff requests a trial by jury and seeks judgment against defendants, statutory damages of $1,000 per defendant, actual damages, attorneys' fees, costs, interest and further relief as the court may deem proper. He is represented by Alex D. Weisberg of Weisberg Consumer Law Group PA in Cooper City.
