Man alleges he is disabled according to terms of disability plan but claim was still denied

Insurance 11

TAMPA – A former clinical systems analyst alleges his claim for disability benefits was wrongfully denied.

Arthur Reinberger filed a complaint on March 24 in the Tampa Division of the Middle District of Florida against The Prudential Insurance Co. of America alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he alleges he became disabled in October 2015, applied for benefits but was denied by the defendant. The plaintiff holds The Prudential Insurance Co. of America responsible because the defendant allegedly failed to pay disability benefit payments to plaintiff despite him being disabled according to the terms of the plan.

The plaintiff seeks judgment against the defendant, unpaid benefits, attorney's fees, costs incurred and further relief as the court deems just. He is represented by William C. Demas and John V. Tucker of Tucker & Ludin PA in St. Petersburg.
