MSC Cruises' alleged negligence caused fall, passenger claims

MIAMI – A passenger on the MSC Divina alleges she was injured by a step on the ship.

Mary Gossett filed a complaint on March 24 in the U.S. District Court for the Southern District of Florida, Miami Division against MSC Cruises SA, formerly known as MSC Cruises (USA) Inc., alleging negligence.

According to the complaint, the plaintiff alleges that on April 10, 2016, while she was aboard defendant's vessel as a paying passenger, she was severely injured when she fell while going down a step located within the vessel. As a result, she alleges she sustained injuries about her body and extremities, suffered physical pain, mental anguish, disability, disfigurement, physical handicap, lost wages and incurred medical expenses. Additionally, plaintiff lost the benefit of vacation, cruise and transportation costs. The plaintiff holds MSC Cruises SA responsible because the defendant allegedly failed to utilize a reasonably safe flooring surface and failed to use contrasting flooring surfaces.

The plaintiff requests a trial by jury and seeks judgment for all damages recoverable under the law against defendant. She is represented by Ricardo V. Alsina and Peter J. Ridge of Lipcon, Margulies, Alsina & Winkleman PA in Miami.
