Consumer claims Credit One Bank harassed him with its hundreds of calls

TAMPA – A Hernando County man alleges a creditor called him 200 times after he revoked his consent to receive calls.

Kevin Isgrigg filed a complaint on March 24 in the Tampa Division of the Middle District of Florida against Credit One Bank NA alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, beginning in November 2016, the defendant contacted the plaintiff to collect on an alleged credit card debt. He alleges he endured abuse and harassment, stress and anxiety, including invasion of privacy, unnecessary expenditure of his time and intrusion on his seclusion, as a result of defendants' incessant calls in an attempt to collect.

The plaintiff holds Credit One Bank NA responsible because the defendant allegedly continued to make calls despite plaintiff's explicit demand to stop the improper calls, and unlawfully utilized an automatic telephone dialing system and/or an artificial or pre-recorded voice.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory, punitive, actual and treble damages, enjoinder from further violations and other relief the court may deem just. He is represented by Frank H. Kerney III of Morgan & Morgan PA in Tampa.
