Cavalry Portfolio Services alleged to have violated debt collection law

ORLANDO – A consumer alleges a debt collector failed to remove disputed debts from his credit report.

Mitchell Schwarzwalder filed a complaint on March 24 in the U.S. District Court for the Middle District of Florida against Cavalry Portfolio Services LLC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that he has suffered economic and emotional damages from defendant's refusal to remove the disputed language from plaintiff's credit report, even though plaintiff no longer wanted to dispute the debt.

The plaintiff holds Cavalry Portfolio Services LLC responsible because the defendant allegedly misrepresented the legal status of the debt, and caused plaintiff's credit score to drop.

The plaintiff requests a trial by jury and seeks judgment against defendant for actual damages, statutory damages, statutory costs and attorney's fees. He is represented by Michael Tierney of Michael Tierney PA in Winter Park.
