Disabled man claims Chevron station does not have facilities that are accessible

MIAMI – A Palm Beach County man alleges a Plantation property does not have a restroom accessible to disabled patrons.

Howard Cohan filed a complaint on March 23, in the U.S. District Court for the Southern District of Florida against Starlight Convenience Store Corp., doing business as Chevron, alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he was discriminated against while using the facilities of the defendant and sustained difficulty utilizing the men's restroom because of defendant's failure to make reasonable modifications to remove all barriers to access and accommodate all individuals, including persons with disabilities. The plaintiff holds Starlight Convenience Store Corp. responsible because the defendant allegedly failed to provide adequate doors, pathways and aisles, and failed to properly position the water closet, toilet paper dispensers and mirrors to allow access.

The plaintiff requests a trial by jury and seeks judgment against defendant, declaratory relief, complete corrective procedures, attorney's fees, all costs, expert fees, and further relief as it may deem just.
