Tiffany files suit against alleged sellers of counterfeit products

MIAMI – Tiffany alleges several online retailers are selling counterfeit goods.

Tiffany (NJ) LLC filed a complaint on March 23 in the U.S. District Court for the Southern District of Florida against tiffanyloveyou.com, 1dong.net, attractionimages.net, et al. alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it has suffered injuries on its reputation, business, and goodwill caused by defendants' wrongful conduct of manufacturing, copying, exporting, importing, advertising, promoting, selling and distributing counterfeit and unauthorized products featuring plaintiff's registered trademarks.

The plaintiff holds tiffanyloveyou.com, 1dong.net, attractionimages.net, et al. responsible because the defendants allegedly caused confusion among consumers by offering counterfeit products and using the same marks as plaintiff's distinctive marks, and capitalized and received the benefit of plaintiff's reputation and goodwill.

The plaintiff requests a trial by jury and seeks judgment against defendants, equitable and monetary relief, account and pay profits from infringement, costs, attorneys’ fees, interest, and further relief as the court may deem just. It is represented by Stephen M. Gaffigan, Virgilio Gigante and T. Raquel Rodriguez-Albizu of Stephen M. Gaffigan PA in Fort Lauderdale.
