WEST PALM BEACH – A Jupiter woman alleges debt collectors have been contacting her at a harassing frequency.
Wanda Laracuente filed a complaint on March 23 in the U.S. District Court for the Southern District of Florida against Medical Data Systems Inc., doing business as Medical Revenue Services LLC, and Jupiter Medical Center alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that the defendants have been contacting her regarding an alleged medical debt at a frequency expected to harass. The plaintiff holds Medical Data Systems Inc., doing business as Medical Revenue Services LLC, and Jupiter Medical Center responsible because the defendants allegedly continued to make calls despite plaintiff's explicit demand to stop the improper calls and unlawfully utilized an automatic telephone dialing system and/or an artificial or pre-recorded voice.
The plaintiff requests a trial by jury and seeks judgment against defendant; statutory, actual and punitive damages; attorney's fees; costs; and equitable relief as the court deems appropriate. She is represented by Sharina T. Romano of Hyslip & Taylor LLC LPA in Chicago.
