LVNV Funding, Credit Control accused of sending letter containing false information

MIAMI – A Miami-Dade County consumer alleges two debt collectors used false information to coerce him to pay an alleged debt.

Klaus Boettcher filed a complaint on March 22 in the U.S. District Court for the Southern District of Florida against LVNV Funding LLC and Credit Control LLC, citing alleged violations of the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on Feb. 15, he suffered harm and damages from receiving a letter from Credit Control that listed LVNV Funding as the original creditor. He claims that the alleged debt is time-barred.

The plaintiff holds LVNV Funding LLC and Credit Control LLC responsible because the defendants allegedly misrepresented the original creditor, last payment date, charge-off date, delinquency date and balance amount in an attempt to coerce the plaintiff to pay a time-barred debt.

The plaintiff requests a trial by jury and seeks judgment against defendants, damages, attorney's fees, litigation expenses, declaratory relief, costs of suit and further relief as the court deems proper. He is represented by Joel D. Lucoff of Debt Rescue Clinic in Miami.
