MIAMI – An Opa Locka property owner alleges a financial institution did not provide the information she requested in a timely manner.
Margie L. Jenkins filed a complaint on March 21 in the U.S. District Court for the Southern District of Florida against Wells Fargo Bank NA alleging violation of the Real Estate Settlement Procedures Act.
According to the complaint, the plaintiff alleges that in February, she was caused injury and suffered actual damages by defendant's failure to respond to any of the specific inquiries made by plaintiff for some of the fees and charges imposed on her loan account without explanation or proof. The plaintiff holds Wells Fargo Bank NA responsible because the defendant allegedly failed to take timely action to respond to a borrower’s requests to correct errors, final balances for purposes of paying off loan or avoid foreclosure.
The plaintiff requests a trial by jury and seeks judgment against the defendant, provide responsive information to the plaintiff's specific requests, actual damages, statutory damages, costs, attorney’s fees, and other relief to which the court may deem just.
