Woman alleges Stuart South Self Storage is not ADA compliant, denied her equal access

FORT PIERCE – A Palm Beach County woman alleges a Stuart business has architectural barriers that restricts access to the disabled.

Janet Hoyt filed a complaint on March 20 in the U.S. District Court for the Southern District of Florida, Fort Pierce against Stuart South Self Storage LLC doing business as A First Class Self Storage, alleging that the defendant violated the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on Feb. 7, plaintiff, a disabled individual, visited the defendant's premises but did not receive full/equal access and full/equal enjoyment of the facilities, services, goods and amenities within the premises, even though she was a bona fide patron.

The plaintiff holds Stuart South Self Storage LLC, doing business as A First Class Self Storage, responsible because the defendant allegedly failed to provide the proper spacing between a grab bar and an object project out of the wall, failed to redirect a person with a disability to the closest available restroom and failed to provide operable parts that are functional or are in the reach ranges as required for a person with a disability.

The plaintiff seeks judgment for reasonable attorneys' fees, all costs, other expenses of suit of plaintiff and such and further relief as it may deem necessary, just and proper. She is represented by Jason S. Weiss and Zachary W. Smith of Weiss Law Group PA in Coral Springs.
