United of Omaha Life alleged to have unlawfully terminated disability benefits

GAINESVILLE – A man alleges his disability benefits were wrongfully terminated.

Darryl Swift filed a complaint on March 13 in the U.S. District Court for the Northern District of Florida, Gainesville Division against United of Omaha Life Ins. Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he was initially paid disability benefits through June 2016, when the defendant terminated benefits on the review of a company nurse. The plaintiff holds United of Omaha Life Ins. Co. responsible because the defendant allegedly failed to consider plaintiff's medical records and clear opinions of his physicians.

The plaintiff requests a trial by jury and seeks judgment for damages, disability benefits and consequential damages, together with interest, attorney’s fees and costs. He is represented by Terence J. Kann of Terence J. Kann PA in Gainesville.
