Man alleges Aetna Life Insurance Co. wrongfully terminated benefits

PENSACOLA – An Escambia County resident alleges his disability benefits were wrongfully terminated.

Joseph Benson filed a complaint on March 10 in the U.S. District Court for the Northern District of Florida against Aetna Life Insurance Co. alleging Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he became disabled in 2014, applied for disability benefits from the defendant and was approved to receive benefits. The suit states the benefits were terminated by the defendant in May 2016. The plaintiff alleges he is still totally disabled.

The plaintiff requests a trial by jury and seeks judgment against the defendant, plan benefits owed, interest, attorney’s fees, costs of this action, and all other relief deemed just. He is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
