Florida resident accuses debt collector of violating law

TAMPA — A Florida woman is suing a debt collector, alleging violation of the Fair Debt Collection Practices Act or FDCPA.

Vicki Lehman filed a complaint March 9, in the U.S. District Court for the Middle District of Florida against Tampa Bay Rental Solutions LLC and James Kopteros, alleging violation of the FDCPA through abusive, deceptive and unfair debt collection practices.

According to the complaint, on Dec. 15, 2016, Lehman suffered from harm and injury as a result of defendants' unfair business practices, which includes sending a three-day notice to evict and attempting to charge fees or costs that are either illegal, excessive or not permitted by law or mortgage agreement. 

The plaintiff alleges the defendants failed to inform her that she had 30 days from the day she received the communication to dispute the debt and obtain validation and verification, and attempted to collect an amount not authorized by law or the loan agreement.

Lehman seeks trial by jury, damages of at least $5,000, interest, costs, attorneys fees, statutory damages in the minimum amount of $1,000 per violation, and all relief the court deems just. She is represented by attorney Scott Stamatakis of Stamatakis Thalji Bonanno in Tampa.
