Passenger blames cruise line for sexual assault

MIAMI — A North Carolina passenger is suing a cruise line, alleging assault, battery, negligence, sexual abuse, and vicarious liability.

Jane Doe filed a complaint Feb. 23 in U.S. District Court for the Southern District of Florida against SeaDream Yacht Club Limited and Rui Manuel Duarte Guerreiro , alleging they caused life-threatening injuries, pain and suffering.

According to the complaint, on June 24, 2015, Doe, a cruise passenger, was injured about her body and extremities, suffered physical pain and suffering, mental anguish, loss of enjoyment of life, physical disability, impairment, lost wages, and impairment of her working ability and earning capacity due to being subjected to a brutal rape and/or sexual assault by Guerreiro, who was working for SeaDream as a bartender.

The plaintiff alleges the defendants failed to protect passengers from being targeted by crew members, failed to adequately supervise and monitor crew members, and that Guerreiro brutally raped and sexually assaulted and battered a helpless passenger.

Doe seeks trial by jury, all damages, including punitive damages. She is represented by attorneys Michael A. Winkleman, Jacqueline Garcell and Jason R. Margulies of Lipcon Margulies, Alsina & Winkleman PA in Miami.
