Carnival passenger alleges head injuries after youth threw coffee mug

MIAMI – A North Carolina man alleges he suffered a brain injury after being struck on the head by an object thrown by another passenger while traveling on a Carnival cruise.

Travis Simmons filed a complaint on March 15 in the U.S. District Court for the Southern District of Florida against Carnival Corp., doing business as Carnival Cruise Lines, alleging negligence and failure to warn.

According to the complaint, the plaintiff alleges that on March 30, 2016, he was struck in the back of the head by a heavy ceramic coffee cup thrown at him from behind by a rowdy youth while on board defendant's vessel. He alleges he suffered a brain injury and orthopedic injuries that required surgery. The plaintiff holds Carnival Corp. responsible because the defendant allegedly failed to train security and other employees to supervise rowdy passengers, and failed to keep sufficient numbers of security to keep order.

The plaintiff requests a trial by jury and seeks judgment from defendant for damages, prejudgment interest and costs. He is represented by Paul M. Hoffman of Hoffman Law Firm in Fort Lauderdale.
