Miramar couple claims Nationstar Mortgage violated RESPA

FORT LAUDERDALE — A Miramar couple is suing Nationstar Mortgage LLC, citing alleged violation of the Real Estate Settlement Procedures Act.

Marjorie and Luguy Desnord filed a complaint on Feb. 22 in the U.S. District Court for the Southern District of Florida against the loan servicer alleging that it breached its duty of good faith and fair dealing.

According to the complaint, the plaintiffs allege that, on Dec. 4, 2016, they suffered harm and injury from defendant's failure to both acknowledge the plaintiffs’ written request for information (RFI) and provide the plaintiffs with the accurate payoff balance statement for their loan obligation. The plaintiffs hold Nationstar responsible because it allegedly failed to respond to any of the specific inquiries made in plaintiffs’ RFI and failed to provide an accurate payoff statement.

The plaintiffs request a trial by jury and seek judgment against defendant, actual and statutory damages, costs, attorney’s fees and other relief to which the court may deem just. They are represented by Michael A. Citron and Matthew Yerachmiel David Bavaro of Loan Lawyers LLC in Fort Lauderdale.
