MIAMI – Two Jupiter companies are alleged to have infringed a Kansas company's patented technology.
Cerner Innovation Inc. filed a complaint on March 10 in the U.S. District Court for the Southern District of Florida against Excel Medical Electronics LLC and Excel Medical Electronics Inc. alleging patent infringement.
According to the complaint, the plaintiff claims that as a result of defendants' alleged infringement, it has suffered and will continue to suffer injury and monetary damages for not receiving royalty payments unless the court enjoins and restrains defendants' activities.
The plaintiff holds Excel Medical Electronics LLC and Excel Medical Electronics Inc. responsible because the defendants allegedly sold, offered to sell, used and/or imported products and services that infringe plaintiff's '608 and '957 patents, titled System for Processing Data Acquired from Multiple Medical Devices and Mobile Discrete Data Documentation, respectively.
The plaintiff requests a trial by jury and seeks compensatory and treble damages, plus interest, attorneys' fees, costs of suit and such other appropriate relief. It is represented by Humberto H. Ocariz of Shook, Hardy & Bacon LLP in Miami.
