Homeowner accuses debt collector of violations

FORT LAUDERDALE — A Broward County homeowner is suing a debt collector, alleging violation of the Real Estate Settlement Procedures Act (RESPA), and the Fair Debt Collection Practices Act (FDCPA).

Mary Beeson filed a complaint Feb. 15 in U.S. District Court for the Southern District of Florida against Seterus Inc. alleging the debt collector breached its duty of good faith and fair dealing.

According to the complaint, Beeson suffered monetary losses from Seterus' act to proceed to auction, while the plaintiff’s loss mitigation application was still pending and being reviewed. 

The plaintiff alleges Seterus failed to give her accurate information about her loss mitigation options, and failed to properly and timely evaluate her loss mitigation application.

Beeson seeks trial by jury, statutory and actual damages, attorney fees, court costs, and all relief available under the law. She is represented by attorney Ruzy Behnejad of Behnejad Law PLLC in Miami.
