Man alleges he was transported under 'horrific and demeaning' conditions by Inmate Services Corp.

FORT MYERS – A California man alleges he suffered dehydration, malnutrition and other ailments while being extradited from California to Florida.

David Hastings filed a complaint on March 10 in the U.S. District Court for the Middle District of Florida, Fort Myers against Inmate Services Corp. alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on April 5, 2014, he was taken into custody by the defendant to be transported to Fort Myers from California for his arraignment. However, plaintiff alleges he was subjected to "horrific and demeaning" extradition across 31 states for 15 days, despite defendant knowing that plaintiff had just suffered a heart attack and spent five days in the hospital before the trip. As a result, he alleges he suffered bodily injury, serious medical problems, malnutrition, dehydration, and mental anguish.

The plaintiff holds Inmate Services Corp. responsible because the defendant allegedly failed to provide plaintiff with adequate food, clothing and medication, caused plaintiff to lose 35 pounds in 15 days from malnutrition, denied plaintiff of medical care and failed to allow plaintiff to use the restroom or stretch throughout the duration of the trip.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of more than $100,000, costs of action, interest, attorney's fees and further relief that the court may deem just. He is represented by Jay Calvert Cooper of Law Office of Jay Calvert Cooper PA in Fort Myers.
