FORT LAUDERDALE – A former employee of Addison County Home, Health and Hospice alleges her insurer wrongfully terminated her disability benefits.
Elizabeth Levesque filed a complaint on March 13 in the U.S. District Court for the Southern District of Florida against United of Omaha Life Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2015, she became disabled and was initially paid disability benefits until they were terminated in 2016. The plaintiff holds United of Omaha Life Insurance Co. responsible because the defendant allegedly denied further payment of plaintiff's disability benefits despite knowing she was entitled to them and failed to properly and adequately investigate the merits of her claim.
The plaintiff seeks payment of disability benefits to the plaintiff, reinstatement, all legal fees, interest, and any other relief as the court deems just. She is represented by Stephen F. Jessup of Attorneys Dell and Schaefer, Chartered in Hollywood.
