Consumer claims Fortiva Financial invaded privacy with collection calls

ORLANDO – An Orlando consumer alleges a debt collector has called her 150 times since she asked for the calls to stop.

Lisa Baxter filed a complaint on March 1 in the U.S. District Court for the Middle District of Florida, Orlando Division against Fortiva Financial LLC alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in July 2016, she sustained damages from receiving numerous collection calls from the defendant, which invaded her privacy. The plaintiff holds Fortiva Financial LLC responsible because the defendant allegedly continued to contact the plaintiff on her cellular telephone despite her request to cease calling.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, interest court costs and any further relief the court grants. She is represented by Octavio Gomez of Morgan & Morgan, Tampa PA in Tampa.
