Man alleges insurers refused to cover cancer treatments

ORLANDO – A Cocoa man alleges his insurers wrongfully denied coverage of a cancer treatment.

Brett Nyquist filed a complaint on March 1 in the U.S. District Court for the Middle District of Florida, Orlando Division against The Group Health Benefit Plan for associates of Publix Supermarkets Inc., Publix Super Markets Inc., Blue Cross and Blue Shield of Florida Inc., and Blue Cross and Blue Shield of South Carolina Inc. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that he needed treatment for brain cancer from the Mayo Clinic in 2015 and the defendants refused to cover the proton beam radiation treatments. The plaintiff holds The Group Health Benefit Plan for associates of Publix Supermarkets Inc., Publix Super Markets Inc., Blue Cross and Blue Shield of Florida Inc., and Blue Cross and Blue Shield of South Carolina Inc. responsible because the defendants allegedly refused to provide the benefits requested by the plaintiff.

The plaintiff seeks judgment against the defendant for damages, benefits, court costs and any further relief this court grants. He is represented by Jeffrey L. Greyber of Merlin Law Group PA in West Palm Beach.
