Liberty Life Assurance Co. of Boston accused of wrongfully terminating man's disability benefits

FORT MYERS – A Lee County man formerly employed by Parker Hannifin Corp. claims his disability benefits were wrongfully terminated.

Robert Applegate filed a complaint on March 2 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Liberty Life Assurance Co. of Boston alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in 2013, he became disabled and was approved to receive long-term disability benefits until the benefits were terminated by the defendant in 2015. The plaintiff holds Liberty Life Assurance Co. of Boston responsible because the defendant allegedly determined that the plaintiff is no longer disabled according to its policy and refused to pay any long-term disability benefits beyond March 27, 2015.

The plaintiff seeks unpaid disability benefits plus interest and reinstatement, court costs and any further relief the court grants. He is represented by Douglas D. Mohney, Carol Avard and Mark Zakhvatayev of Avard Law Offices PA in Cape Coral.
