Woman claims she received unwanted telemarketing calls from H.O.P.E. Program

FORT MYERS – A Georgia woman alleges she received harassing telemarketing calls from a Bonita Springs company and has filed a class-action suit.

Kelly Fillion-Frye filed a complaint on behalf of all others similarly situated on Feb. 24 in the U.S. District Court for the Middle District of Florida against The H.O.P.E. Program LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in September 2016, she suffered damages from receiving several unwanted calls and text messages on her cellular telephone from the defendant in its attempt to solicit its services. The plaintiff holds The H.O.P.E. Program, LLC responsible because the defendant allegedly kept on calling the plaintiff despite her request to stop calling her.

The plaintiff requests a trial by jury and seeks actual and statutory damages, injunction against the defendant, all legal fees and any other relief as the court deems just. She is represented by Stefan Coleman of Law Offices of Stefan Coleman PA in Miami.
