Aventura Beach Associates accused of interfering with employee's right to FMLA leave

MIAMI – A Miami-Dade County woman alleges she was retaliated against after she took a medical leave.

Marie Toussaint filed a complaint on Feb. 23 in the U.S. District Court for the Southern District of Florida, Miami Division against Aventura Beach Associates LTD, doing business as Marco Polo Beach Resort and also known as Ramada Hotel, citing the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that she was hired as a laundry room attendant in 2010 for the defendant. In October 2016, she had surgery, returned to work with restrictions, and was later approved for FMLA leave from November 2016 to February 2017. The suit states she returned to work in January 2017, but could not mop floors because of her condition. She alleges she was terminated on Jan. 30, 2017.

The plaintiff holds Aventura Beach Associates LTD responsible because the defendant allegedly failed to inform the plaintiff of her rights to FMLA, interfered with those rights and instead terminated her employment.

The plaintiff requests a trial by jury and seeks actual damages, back pay, front pay, benefits, compensatory damages, liquidated damages, reinstatement, all legal fees and any other relief as the court deems just. She is represented by R. Martin Saenz of Saenz & Anderson PLLC in Aventura.
