Tiffany (NJ) LLC claims online retailers are selling counterfeit goods

MIAMI – A New Jersey based boutique operator alleges counterfeit versions of its goods are being sold online.

Tiffany (NJ) LLC filed a complaint on Feb. 21 in the U.S. District Court for the Southern District of Florida against the tfcool.us, bagfc.us, nextluxuryfashion.com, et al. alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business and reputation from having its mark used on lesser-quality products. The plaintiff holds tfcool.us, bagfc.us, nextluxuryfashion.com, et al. responsible because the defendants allegedly use their websites to sell counterfeit products while using plaintiff's trademark on those products.

The plaintiff seeks enjoin the defendants, order the defendants to disable all domain names being used, statutory damages of $2 million per each counterfeit mark, all legal fees, interest, and any other relief as the court deems just. It is represented by Stephen M. Gaffigan, Virgilio Gigante and T. Raquel Rodriguez-Albizu of Stephen M. Gaffigan PA in Fort Lauderdale.
