Woman alleges floor drain caused her to fall at Circle K location

FORT MYERS – A woman alleges she was injured at a Lehigh Acres gas station/convenience store because of an exposed floor drain.

Stephanie A. McCullagh filed a complaint on March 8 in the 20th Judicial Circuit Court of Florida - Lee County against Circle K. Stores Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 20, 2016, she sustained serious physical injuries when she tripped over an exposed floor drain in the women's restroom. The plaintiff holds Circle K. Stores Inc. responsible because the defendant allegedly failed to warn the plaintiff regarding the uncovered floor drain and for violating applicable building codes or ordinances.

The plaintiff requests a trial by jury and seeks compensatory damages that exceed $15,000 plus interest, court costs and any other relief as the court deems just. She is represented by Christopher J. Smith of Cechman, Rice & Purtz PA in Fort Myers.
