FORT MYERS – A Collier County man alleges he was terminated following his complaints of age discrimination.
Mark Bevilaque filed a complaint on March 2 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against The Lykos Group Inc. and Thomas Lykos citing the Fair Labor Standards Act, the Age Discrimination in Employment Act and the Florida Civil Rights Act.
According to the complaint, the plaintiff alleges that on Oct. 14, 2016, he was terminated by the defendants and replaced by an individual that was several years younger than he. The plaintiff holds The Lykos Group Inc. and Lykos responsible because the defendants allegedly failed to compensate plaintiff for all hours worked, failed to uphold plaintiff's rights as a member of a protected class, and interfered with employee's contractual rights to enjoy the same benefits and privileges as other employees.
The plaintiff requests a trial by jury and seeks judgment against defendants, liquidated damages, injunctive and declaratory relief, back pay, front pay, reimbursement of expenses, costs of litigation, interest, attorney's fees, costs, compensatory and punitive damages, and further relief as the court deem just.
