TAMPA – A Hillsborough County consumer alleges she was intentionally harassed by a debt collector in its attempt to contact a relative.
Juliana Barbosa filed a complaint on March 1 in the Tampa Division of the Middle District of Florida against The Hertz Corp. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that beginning in 2016, she suffered damages from being called several times on her cellular telephone by the defendant in its attempt to reach her sister. The plaintiff holds The Hertz Corporation responsible because the defendant allegedly continued to call the plaintiff after she revoked her permission to receive the defendant's calls. She alleges the defendant called 100 times.
The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, interest, all legal fees and any other relief as the court deems just. She is represented by Frank H. Kerney, III of Morgan & Morgan Tampa, P.A. in Tampa.
