TAMPA – Three former employees of a St. Petersburg bakery allege they are owed unpaid wages.
Wendy Bell, Kristian Kinder and Elizabeth Osteen filed a complaint on behalf of others similarly situated on Feb. 27 in the Tampa Division of the Middle District of Florida against The Cupcake Spot & Sweet Inc. and Carlos Delgado, also known as Miguel Delgado and Daniel Delgado, alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiffs allege that they were misclassified as being exempt from receiving overtime pay. The plaintiffs holds The Cupcake Spot & Sweet Inc. and Delgado responsible because the defendants allegedly failed to pay overtime wages to the plaintiffs despite working more than 40 hours per week.
The plaintiffs request a trial by jury and seek payment of unpaid wages, interest, all legal fees, punitive damages, and any other relief as the court deems just. They are represented by Peter L. Tragos of Tragos, Sartes & Tragos PLLC in Clearwater.
