Former kitchen helper for Latino Grocery/Spanish Food Inc. claims she was not paid overtime rate

ORLANDO – An Orange County woman claims she was not paid overtime for her work as a kitchen helper.

Xiomara Alba filed a complaint on Feb. 24 in the U.S. District Court for the Middle District of Florida, Orlando Division against Latino Grocery/Spanish Food Inc. and Jose Espinal alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked an average of 57 to 64 hours a week for the defendants. The plaintiff holds Latino Grocery/Spanish Food Inc. and Espinal responsible because the defendants allegedly did not pay her at a rate of time-and-one-half of her regular wages for overtime work.

The plaintiff requests a trial by jury and seeks judgment against defendant, unpaid overtime compensation, liquidated damages, interest, attorney's fees, costs and further relief as the court deems just. She is represented by Cynthia Gonzalez and Luis Roberto Amadeo of Cynthia Gonzalez PA in Tampa.
