ORLANDO – A Casselberry woman alleges a letter she received from a debt collector did not include information required by law.
Tonia Smith filed a complaint on Feb. 24 in the U.S. District Court for the Middle District of Florida, Orlando Division against Kelley Kronenberg PA alleging that the debt collector violated the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that on Feb. 26, 2016, she suffered harm and damages from receiving a letter from the defendant in an attempt to collect on an alleged debt. The plaintiff holds Kelley Kronenberg PA responsible because the letter allegedly did not contain any of the disclosures required in an initial communication and was inconsistent with the notice of plaintiff's right to dispute and verify the debt.
The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages of $1,000, actual damages, attorney's fees, costs, interest, and further relief as the court may deem proper. She is represented by Alex D. Weisberg of Weisberg Consumer Law Group PA in Cooper City.
