BMI claims River Rocks performed music without authorization

ORLANDO – A Rockledge business is accused of unlawfully performing musical compositions without a license.

Broadcast Music Inc., et al. filed a complaint on Feb. 23 in the U.S. District Court for the Middle District of Florida, Orlando Division against River Rocks LLC, doing business as River Rocks and The Dock at River Rocks, Michael Melhado and Tracy Silverthorn alleging copyright infringement.

According to the complaint, the plaintiffs allege that they have suffered monetary losses from defendants' wrongful conduct of using plaintiffs' musical compositions for public performance at the establishment owned by the defendants. Since April 6, 2010, the suit states the plaintiffs have reached out to the defendants more than 60 times by phone, mail, email and in-person to cease and desist all use of licensed music or to purchase the necessary license to perform plaintiffs' repertoire.

The plaintiffs request a trial by jury and seek judgment in their favor, enjoin and restrain defendants from further infringement, statutory damages, costs, attorney's fees, and further relief as is just. They are represented by Zachary D. Messa of Johnson Pope Bokor Ruppel & Burns LLP in Clearwater.
