Law money 06

MIAMI – A Dade County man formerly employed as a sous chef claims he was not paid properly for overtime work.

Juan C. Paula filed a complaint on behalf of all others similarly situated on March 1 in the U.S. District Court for the Southern District of Florida against La Cucina Management Inc., doing business as Perricone's Marketplace & Cafe, and Steven Perricone alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked as a sous chef for the defendants from 2008 to 2017. The plaintiff holds La Cucina Management Inc., doing business as Perricone's Marketplace & Cafe, and Perricone responsible because the defendants allegedly failed to compensate the plaintiff for working more than 40 hours per week at the legal rate of one-and-one-half his regular rate of pay.

The plaintiff requests a trial by jury and seeks double damages, all overtime wages still owing, all legal fees and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
