Phone 07

OCALA – A Citrus County resident claims a debt collector harassed her with numerous texts and calls in its attempt to collect an alleged debt.

Stacey Iddings filed a complaint on Feb. 23 in the U.S. District Court for the Middle District of Florida, Ocala Division against CitiMortgage Inc. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in March 2016, she sustained injury caused by defendant's barrage of calls and text messages using an automatic telephone dialing system and prerecorded voice in an attempt by the defendant to collect on plaintiff's alleged debt.

The plaintiff holds CitiMortgage Inc. responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, contacted plaintiff without prior express consent and unlawfully utilized an auto-dialer and automated voice.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory, punitive, and actual damages; costs; interest; attorney's fees; enjoinder from further violations; and other relief as the court may deem just. She is represented by Jared M. Lee of Morgan & Morgan Tampa PA in Orlando.
