Montgomery Ward accused of harassing consumer with calls

JACKSONVILLE – A Duval County consumer claims a company has called her more than 200 times in an attempt to collect an alleged debt.

Francis Samuels filed a complaint on Feb. 24 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Montgomery Ward Inc. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in January 2016, the defendant called her more than 200 times using an automatic telephone dialing system and prerecorded voice to collect on plaintiff's alleged debt. The plaintiff alleges she did not purchase a product from the defendant.

The plaintiff holds Montgomery Ward Inc. responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, contacted plaintiff without prior express consent and unlawfully utilized an automatic dialer and automated voice.

The plaintiff requests a trial by jury and seeks judgment against defendant; statutory, actual and punitive damages; costs; interest; attorney's fees; enjoinder from further violations; and other relief as the court may deem just.
